PIONEERING HEALTH TECH LAW IN THE UAE

As Dubai prepares to host the WHX Tech Conference this September, the United Arab Emirates stands at the forefront of a transformative era in health technology law and innovation. The nation’s ambitious legal and regulatory reforms are not only fostering a robust environment for medical product development, but are also positioning the UAE as a regional and global leader in health tech innovation.

A legal framework designed for innovation
The UAE’s approach to health technology regulation is characterised by a forward-thinking, innovation-centric legal framework. Central to this is Federal Law No. 2 of 2019, which governs the use of information and communication technology (ICT) in health fields. This law establishes comprehensive standards for the management, security, and interoperability of health data, ensuring that digital health solutions can be developed and deployed with confidence in their safety, privacy, and effectiveness. Key provisions of the law mandate the secure storage and processing of health data within the UAE, with strict controls on cross-border data transfers. The law also requires the integration of health authorities and relevant entities into a central system for health data exchange, promoting seamless collaboration and data-driven innovation across the healthcare ecosystem. By aligning with international best practices and emphasising data protection, the UAE has created a trusted environment for both local and international innovators.

The Emirates Drug Establishment: A catalyst for medical product innovation
A landmark development in the UAE’s health tech landscape is the establishment of the UAE Drug Corporation (Emirates Drug Establishment) under Federal Decree-Law No. 28 of 2023. This federal entity is tasked with regulating medical and pharmacological products across the country, with a clear mandate to elevate the UAE as a global centre for medical product innovation. The Corporation’s powers are extensive and strategically aligned with the nation’s innovation goals. It is responsible for promoting research and development in pharmacological and medical products; attracting leading investments in research and medical industries; strengthening local industrial capacity for the development, production, and export of high-quality medical products; overseeing the approval, manufacturing, marketing, and monitoring of medical products, including those based on advanced technologies such as artificial intelligence and personalised medicine; and establishing national frameworks for clinical trials, pharmacogenomics, and pharmacovigilance, ensuring that the UAE remains at the cutting edge of medical research and patient safety.

By centralising regulatory authority and streamlining processes, the Emirates Drug Establishment is reducing barriers to market entry, accelerating the approval of innovative therapies, and supporting the growth of a vibrant life sciences sector.

Dubai’s Innovation Ecosystem: A magnet for global talent and investment
Dubai, in particular, is rapidly emerging as a nexus for health tech innovation, supported by a constellation of world-class projects and infrastructure. The upcoming innovation centre at the Mohamed Bin Rashid Medical University is set to become a hub for translational research, digital health, and biotechnology, fostering collaboration between academia, industry, and government.

Dubai Science Park, already home to a thriving community of pharmaceutical, biotech, and medtech companies, continues to expand its offerings with state-of-the-art laboratories, incubators, and business support services. These initiatives are complemented by Dubai’s commitment to creating a business-friendly environment, with policies that encourage foreign direct investment (FDI), 100 per cent foreign ownership in many sectors, and streamlined licensing for health tech startups and manufacturers.

A regional leader in artificial intelligence and digital health
The Department of Health (DOH) in Abu Dhabi has also issued pioneering policies on the use of artificial intelligence in healthcare, setting out clear requirements for transparency, safety, privacy, and accountability. These policies ensure that AI-driven solutions are robust, ethically sound, and aligned with international standards, further enhancing the UAE’s reputation as a safe and attractive destination for digital health innovation.

With the convergence of progressive legislation, visionary regulatory bodies, and a dynamic innovation ecosystem, the UAE is uniquely positioned to lead the next wave of health tech advancements.
